Introduction

1. Welcome to the UGC Policy Polaroid App (the Policy). We’re glad that you are here.

2. You are reading this policy because you would like to submit content (such as photos, videos, text, account names, information, graphics, etc. (the Content)) within the Polaroid App (the App).

3. By submitting Content within the App you affirm that you have read, understand and accept this Policy.

4. You also represent that you are at least 18 years old.

Submitting Content

5. You may submit Content via one of the features available in the Polaroid App. These features may change from time to time depending on editorial governance, popularity or other variables. Features can include:

  • Arrowa. Instant Answers – If you have a question about a Polaroid picture taken by you, you can submit this picture together with your question via the feature ‘Instant Answers’. While we can’t answer all questions, we’ll do our best to answer as many questions as possible. If your question gets selected, your picture together with your name (and/or social media handle), will be publicly featured in the App and other digital channels of Polaroid.
  • Arrowb. Creative Calls – From time to time, Polaroid will launch a Creative Call in which we ask users to submit Polaroid pictures taken by them on a certain theme. Submitted pictures will be publicly featured in the App (provided that they meet the requirements as included in section 11 below). App users get the opportunity to vote for their favorite submission. The submissions with the most votes will also be featured in a winners gallery in the App and other digital channels of Polaroid. In addition to the user’s vote, Polaroid will also select a number of submissions based on the requirements (i) interpretation of the theme, (ii) creativity, and (iii) technique to be featured in a winners gallery and/or weekly gallery.

Use of the Content

6. By submitting Content, you automatically grant to Polaroid the non-exclusive, royalty-free, sublicensable, transferable, worldwide right to disclose and distribute (parts of) the Content together with your name (and/or social media handle) within any feature of the App, on Polaroid’s social media channels, websites and e-newsletter. You warrant that you are authorized to grant this right to Polaroid.

7. By submitting Content, you agree and understand that your Content can become publicly available in the App, on Polaroid’s social media channels, websites and e-newsletter and that other users can access your Content.

8. By submitting Content, you also automatically grant Polaroid the non-exclusive, royalty-free, sublicensable, transferable, worldwide right to analyze and otherwise use (parts of) the Content to improve its services and products and to conduct data analysis, testing and research.

9. You will retain the ownership and any possible intellectual property rights to the Content.

10. We will not edit the Content, provided that we will translate text to various languages, and we will update text to conform to the Polaroid brand guidelines.

Content Requirements

11. You agree and acknowledge that any Content submitted meets the following requirements:

  • Arrowa. The Content is your own original creation;
  • Arrowb. The Content (or parts thereof) is not generated with AI;
  • Arrowc. You own or have obtained all necessary rights to the Content (including permission from the people visible in the Content);
  • Arrowd. The Content does not infringe any third-party rights, like tradenames, trademarks, copyrights, portray rights and/or privacy rights;
  • Arrowe. The Content does not have a defamatory character, as determined by Polaroid in its sole discretion;
  • Arrowf. The Content does not portray or depict any person, product or company in a false light, as determined by Polaroid in its sole discretion;
  • Arrowg. The Content is not objectionable (showing criminal behavior, violence, hate speech, sexual abuse, sexual solicitation, adult nudity, offering or linking to firearms, pornographic or adult-themed material, gambling or drugs etc.), as determined by Polaroid in its sole discretion;
  • Arrowh. Any children depicted in the Content are your own;
  • Arrowi. The Content does not otherwise violate any laws or regulations.

Moderation

12. To ensure that the App remains a safe place for everyone, Polaroid uses human review in conjunction with automated systems to identify Content that violates this Policy and/or any laws or regulations.

13. Polaroid can at our own discretion decide not to disclose or to delete Content in the App and its other digital channels when we believes that the Content is in breach of this Policy and/or violates any law or regulations.

Reporting Content

14. If you wish to report certain Content within the App (for example because you experience the Content to be illegal, offensive, indecent, objectionable, or infringing of your or third-party rights), please contact us via services@polaroid.com or legal@polaroid.com. In your report, please provide us with (i) your name and email address, (ii) a reference to the Content, and (iii) motivation for reporting the Content. We aim to acknowledge receipt of your report within 5 working days, and we will without undue delay inform you of the outcome of our investigation into the reported Content.

Personal data

15. By submitting Content, you consent to Polaroid processing your Content, name, email address and any other personal information provided by you, for the purpose of disclosing and distributing the Content (in combination with your name and/or social media handle) within the App, on Polaroid’s social media channels, websites and e-newsletter. Polaroid can use your email address to contact you for collaboration opportunities in relation to your Content.

16. You may request Polaroid to remove the Content you have submitted and disclosed by Polaroid at any time by reaching out to services@polaroid.com or privacy@polaroid.com.

Other terms

18. You agree and acknowledge that you shall be solely responsible and liable for any damage resulting from the submitting of the Content/use thereof by Polaroid in line with this Policy. You will indemnify Polaroid from any damages incurred as a result of the use of the Content.

19. This Policy will be governed by Dutch law. The court in Amsterdam will have exclusive jurisdiction of any dispute related to this policy.

20. This Policy may be updated by Polaroid from time to time, upon which the amended terms shall become binding.
